TERMS & CONDITIONS OF SALE
These are the terms and conditions of sale of Odil & Odil. These terms and conditions of sale (“Conditions”) apply to all orders placed by you with Odil & Odil via its webstore (www.odilodil.com). By placing an order, you agree to the applicability of these Conditions on the agreement between you and Odil & Odil.
These Conditions set out the rights and obligations of the parties that apply to your ordering of products via the webstore of Odil & Odil. It is therefore important that you take the time to read these Conditions carefully. Odil & Odil recommends storing these Conditions on your computer and/or printing them for your records.
1.Information about Odil & Odil
1.1 Odil & Odil is a trade name of Al Primo Piano, a company under the laws of the Netherlands registered at Polenenstraat 33 – 02, 3062 KB Rotterdam, the Netherlands, registered with the Chamber of Commerce under number 71753001
2.1 To enable the smooth and timely execution of the agreement by Odil & Odil, it is important that you correctly and completely provide your name, your e-mail address and the delivery address as per the instructions. You are responsible for the accuracy of the details provided by you. You will find the full contact details of Odil & Odil under Article 1 of these Conditions.
3.Offer and Agreement
3.1 When you buy an article via the webstore of Odil & Odil, you enter into an agreement with Odil & Odil. The agreement starts from the moment you accept the general sales conditions at the checkout on the website.
3.2 An agreement arising from an offer which contains an obvious mistake and/or error, such as an unusually low price, is not binding upon Odil & Odil. Please contact Odil & Odil when you doubt the validity of an offer.
4.Price and Payment
4.1 All prices on the website, order confirmation or any
documentation or correspondence are in Euro and include any Value Added Tax (VAT). For non-EU countries see article 5.3.
4.2 The price quoted in the webstore when you place an order is the total price including all taxes and, if applicable, delivery charges.
4.3 You can pay for your order in the ways indicated in the webstore of Odil & Odil.
5.Order Processing and Delivery
5.1 Odil & Odil aims to process and deliver your order as smoothly and quickly as possible. In the unlikely event that the relevant order is no longer available, Odil & Odil will inform you and refund the paid amount for the relevant product.
5.2 Orders are shipped to the delivery address provided by you and must be an accurate, physical address (No postal address or PO box address).
5.3 All countries within the European Union are shipped on DDP (Delivery Duty Paid) basis, which means that taxes and duties are included in the final price or there is a small flat rate for delivery. If the delivery address is located outside the European Union, its possible that the country in question charges additional levies, such as import tax, Value Added Tax (VAT), duties and other costs. Odil & Odil has no influence or control over such levies and can therefore not provide you with further information. You must check yourself if the ordered articles can be exported and imported to the country in question and what the costs are, before placing such an order.
5.4 Ownership of the ordered products passes to you as soon as Odil & Odil has received full payment.
5.5 Odil & Odil takes great care to ensure that products are shipped accurately and in full. Should you unexpectedly receive incomplete or damaged products, please contact Odil & Odil.
5.6 All orders are fully traceable through your tracking code. Delivery times are provided as guidelines only, and do not take into account possible delays caused by payment authorization and/or stock availability.
6.1 Odil & Odil aims to display products on its website as fully and accurately as possible. The nature of the
offered products may result in differences (such as colour differences) between the display of products on the website and the product delivered to you.
6.2 All the products in the Odil & Odil collection is made with great care to meet your expected quality standards. However, we expressly point out that these products are also designed from an aesthetic point of view, and not solely with a view of optimum lifespan, practical usefulness or ease of use.
7.Right of Withdrawal
7.1 You have the right to terminate the agreement within 15 days after receipt of all the products in your order, without giving any reasons for doing so. This is the socalled cooling-off period. If you make use of your right to terminate the agreement you have to notify Odil & Odil within the reflection period using the withdrawal form or by means of another unambiguously/ clear statement to firstname.lastname@example.org.
7.2 If you choose to terminate the agreement as far as a particular product is concerned, you are required to return this product as soon as possible, but no later than 15 days after receipt of all the products in your order, to the address of Odil & Odil as stated in Article 1.1. The direct costs of the return shipment of the product to Odil & Odil are for your own account.
7.3 In case of termination within the meaning of Article 7.1, Odil & Odil refunds the amount paid for the product in question immediately and in any case no later than fifteen (15) days after receipt of the notice that you wish to terminate the agreement, but not before Odil & Odil has received the returned product in question.
7.4 The termination right within the meaning of Article 7.1 is meant to determine if the product is suitable and if you indeed want the product. It is permissible to try the product as far as necessary to verify whether or not you actually want the product, just like you would do in a retail space. Further use of the product, such as wearing the product in a public space or any other actual use, affects your termination right as set out in more detail in Article 7.5.
7.5 We ask that items are returned clean, unworn and with all their tags attached. Shoes must be returned with their original boxes or bags (including any plastic bag or dust bag). Naturally any faulty item can be returned. Any non-faulty items that are not in a condition suitable for resale (i.e. used, washed, soiled or damaged), will not be refunded and will be sent back to you and the costs of resending will be on your account.
8.1 www.odilodil.com’s contents, including but not limited to, works, images, pictures, dialogues, music, sounds, videos, documents, drawings, figures, logos and any other material published on www.odilodil.com, including menus, web pages, graphics, colours, schemes, tools, the website’s fonts and design, diagrams, layouts, methods, processes, functions and software which are part of www.odilodil.com, and are protected by copyright and by all other intellectual property rights of Odil & Odil. The reproduction, wholly or in part, and in any form whatsoever, of www.odilodil.com and of its contents is forbidden without Odil & Odil’s written consent.
9.Changes to these Conditions
9.1 If Odil & Odil decides to change these Conditions, it will publish the changed Conditions on its website. You are advised to check on a regular basis if the Conditions have changed. Any changes do not apply to orders that were placed before the date of change.

10.2 If you have gone through the complaint procedure, but you want your complaint referred to another authority, you can contact the Dispute Commission via the European ODR. Platform: http://ec.europa.eu/consumers/odr/
11.1 Dutch law applies to these Conditions and to the agreements between you and Odil & Odil, with the exclusion of the Vienna Sales Convention. This choice of law shall not affect any further protection that you have based on the mandatory provisions of the law that would apply without this provision.
